National Law Journal Names Jason Mudd an IP Trailblazer

//

Erise IP is pleased to announce that Shareholder Jason Mudd has been named to the National Law Journal’s list of 50 Intellectual Property Trailblazers & Pioneers. The IP Trailblazers & Pioneers award seeks attorneys “that have innovated and/or are innovating in the field and changed the way copyright, patent, trademark or licensing law is practiced or how IP is protected and managed.”

Mudd led a legal team and client that was the first to file, the first to argue and the first to obtain a favorable ruling in the new inter partes review process. He represented Garmin – the global leader in GPS – in the first ever inter partes review (IPR) before the Patent Trial and Appeal Board, and in November 2013, Jason played a key role in securing a favorable ruling for his client.

In the case, Garmin International Inc. et al. v. Cuozzo Speed Technologies LLC, Garmin fought a patent held by Cuozzo. After Jason represented and argued on behalf of Garmin at the United States Patent and Trademark Office under the America Invents Act, the USPTO issued a final decision, construing Cuozzo’s patent in a way that could not cover technology like that employed by Garmin and holding all claims under review unpatentable.

What Jason accomplished in uncharted territory paved the way for future fights against overbroad assertions of invalid patents.

In publishing the list of honorees, the publication stated that “this year’s winners are a snapshot of success and extraordinary leadership in an area critical to innovation throughout the world.”
