Adam is a founding member of Erise IP and an established trial lawyer in the district courts, at the Patent Trial and Appeal Board, and at the International Trade Commission. He has litigated more than 100 intellectual property matters in district courts across the country; has coordinated multiple global litigation campaigns; and has been lead counsel on more than 187 IPRs and 26 Federal Circuit appeals.

Adam is particularly adept at litigating cases at the PTAB; he is consistently ranked by Patexia among the 10 most active attorneys at the PTAB for petitioners. He also is ranked among the best performing attorneys for outcomes obtained for both petitioners and patent owners. These rankings have consistently put him in the top 1% of all attorneys who litigate before the PTAB.

Adam’s litigation record also comprises numerous defense verdicts in district courts and at the ITC. He is equally accomplished in offensive campaigns for clients, with a record of meaningful jury verdicts:

  • Secured a complete defense verdict of noninfringement for Garmin, which was accused of infringing a patent related to smart watches and fitness tracking.
  • Secured a complete defense verdict for Coca-Cola in a trademark case where he successfully brought a defense of champerty, a little used defense that prevents companies from purchasing lawsuits.
  • Obtained a settlement as plaintiff’s counsel for a local university in Missouri, who asserted their patents covering dry eye chemical compounds against a large pharmaceutical company. The license could be worth over 9-figures by the time the patents expire.
  • Managed and tried cases for telecom clients that resulted in hundreds of millions in verdicts and licenses.
  • Obtained a complete defense outcome at the ITC of noninfringement, invalidity, and inequitable conduct for ErgoBaby, in a case relating to baby carrier design. The complainant dismissed the case during Commission review without further appeal.

Adam’s experience in all three forums—the PTAB, the district courts and the ITC—encompasses a wide variety of client assets, including telecommunications, mobile devices, navigation, GPS, mechanical, crossbows and archery, pharmaceutical, and nearly every manner of electrical and computer-based technology.

He is named among the “Leading Lawyers” for Intellectual Property by Chambers USA, which described him as “one of the state’s leading lights in intellectual property matters, with clients benefiting from his well-honed strengths in IP litigation matters.”

Highlights

  • Obtained defense verdict in the U.S. Court for the District of Kansas for Garmin Ltd. The patent infringement case related to the use of accelerometers to measure angles and velocity and initially involved the assertion of nearly 100 claims.
  • Went “three-for-three” at the Patent Trial and Appeal Board on behalf of a global technology leader accused of patent infringement. Adam’s team petitioned for inter partes review on the three relevant patents and prevailed on all three.
  • Successfully defended baby carrier manufacturers in an International Trade Commission investigation over patent infringement allegations.
