Erise secured a key win at the U.S. Circuit Court of Appeals for the Federal Circuit on behalf of client Unified Patents.
The appellant, Mobility Workx LLC, owned a patent “generally directed to allocation of communication resources in a communications network.” In June 2018, Erise and Unified Patents filed a petition at the Patent Trial and Appeal Board seeking inter partes review (IPR) of seven claims in this patent, citing obviousness.
In December 2019, the PTAB issued its final written decision in the IPR, determining that five of the seven claims were unpatentable as obvious. Mobility then appealed to the Federal Circuit.
In its decision, issued July 14, 2022, the Federal Circuit affirmed the PTAB’s decision holding the five claims unpatentable.
