Erise Wins Patent Infringement Appeal at Federal Circuit

Erise shareholders Megan Redmond, Eric Buresh and Carrie Bader secured a big win before the Federal Circuit for their client, FanDuel.

The case was original filed several years ago and included the alleged infringement of 12 patents. Through a series of invalidation proceedings in the district court and the patent office, Erise was able to reduce the case to one asserted patent. Then the District Court of Delaware invalidated the final patent, where the judge found the patent claimed nothing more than the abstract idea of configuring a game based on location using conventional technology.

As Law360 reported, the original “Delaware federal judge had labeled a ‘jackpot’ victory against CG Technology Development’s mobile device patent infringement claims.” The Federal Circuit affirmed this ruling, which decisively ends CG Technology’s 12-patent campaign against FanDuel.
