Erise shareholders Eric Buresh, Mark Lang and Michelle Marriott secured its client more than $850,000 in legal fees after successfully defending the video game developer against claims that it infringed a patent that covers a system meant to control a virtual reality environment.
On September 3, the Delaware federal judge, U.S. District Judge Leonard P. Stark, agreed with Buresh and Marriott that the plaintiff Princeton Digital had “weak litigation positions and unreasonable litigation tactics.” The Court also found that Princeton Digital pursued a “baseless infringement claim” and awarded Erise’s client, Ubisoft, $867,000 in legal fees.
As Law360 reported, the judge stated, “No reasonable factfinder could conclude that Ubisoft’s accused games infringed.”
“PDIC’s pursuit of a baseless infringement claim prolonged this litigation unreasonably and caused Ubisoft to incur needless litigation expenses,” Judge Stark said.
